Criminal Record Reform | Manzi, Seccareccio & Merwin, P.C. is a ...

On May 4, 2012 new Massachusetts Criminal Offender Record Information (CORI) reform laws went into effect. ?The laws set out new requirements for employers to gain access to criminal records. ?Many people previously convicted of crimes want to hire us to seal their criminal records. ?Sealing criminal records can be useful in protecting your information from most employers and landlords. ?For example, if you seal your criminal record and you apply for a job, you may say that you have no criminal record.

Some convictions can never be sealed. ?Some crimes are sealable but only after the passage of a certain amount of time. ?Some employers and governmental entities can access a sealed criminal record.

Most convictions must be sealed by the Probation Department, but some convictions can be sealed by a judge. ?A judge can also seal cases that were dismissed, resulted in a not guilty finding, or resulted in a nolle prosequi (the prosecution dropped the case).

If you are not a citizen do not try to seal your criminal record without first speaking to an immigration attorney. ?We are not immigration attorneys, but we may be able to refer you to one. ?You may need access to the records to apply for citizenship.
